Court of Appeal quashes ruling seizing Rivers State statutory allocation

The Court of Appeal Friday dismissed an attempt to seize Rivers State’s statutory allocation in a landmark decision.

Justice Hamma Akawu Barka upheld the notion that state revenue matters should not be heard by federal courts when he decided on December 13, 2024, that the Federal High Court lacked jurisdiction over the case.

Justice Barka blasted the Federal High Court for going too far and deemed the action brought by Martin Amaewhule and his supporters to be a flagrant abuse of the judicial system.

The Court warned that improperly identifying federal entities is a legal short cut that will not stand and ruled that concerns pertaining to state money cannot be considered under the pretence of federal jurisdiction.
