Ondo high court orders garnishee of state funds over ₦30m judgment

The Ondo State High Court sitting in Akure has granted a garnishee order nisi directing the attachment of funds belonging to the Ondo State Government to recover a ₦30 million judgment debt.
The order was made on December 10, 2025, by Justice Omolara Adejumo, following an application by the judgment creditor through Tope Temokun Chambers, signed by Tope Temokun, Esq.
The debt arose from a 2023 judgment awarding ₦30 million in damages against the Ondo State Government and the Ondo State Security Network Agency, Amotekun Corps, over injuries sustained by Mr. Oluwasegun Oluwarotimi.
Oluwarotimi, a commercial motorcyclist, was reportedly shot in the leg by operatives of the Amotekun Corps in August 2021, an incident that later resulted in the amputation of his leg.
Although the state government appealed the judgment, the Court of Appeal, Akure Division, in November 2024 struck out the appeal for incompetence, leaving the High Court’s decision subsisting and binding.
At the garnishee proceedings, counsel to the judgment creditor urged the court to compel banks holding Ondo State Government funds to attach the judgment sum from any account operated by the state or its agencies.
Granting the request, the court ordered several commercial banks to attach the ₦30 million and directed them to file returns showing compliance and explain why the order should not be made absolute.
