Ondo police accused of defying court order granting defendant bail

The Ondo State Police Command has been accused of disregarding a court order granting bail to a defendant, Ojo Ware, with his lawyer alleging that his client collapsed after being chained in custody.

Ware, an indigene of Oka-Akoko in Ondo State, was arrested on September 23, 2026, and remained in detention as proceedings concerning his remand continued in court.

His counsel, Victor Ajayi, alleged that the police initially obtained an ex parte order on September 6 to detain his client. However, the defence challenged the order, leading to its reversal.

Ajayi further claimed that the police subsequently filed another ex parte application before Magistrate Court 2 at the New Complex in Akure. According to him, the court directed the prosecution to serve the application on the defence to allow it to respond.

The lawyer alleged that the police later approached another court and secured a fresh ex parte order authorising Ware’s detention for seven days.

When the defence received the motion on notice on October 9, the matter was adjourned until October 13 to enable Ajayi to file a counter-affidavit opposing the application.

At the resumed hearing, prosecution counsel, T.S. Abisagbo, presented the application, while Ajayi submitted the defence’s counter-affidavit. The proceedings followed the dispute over the legal basis for Ware’s continued detention.

The allegations have raised questions about the handling of the defendant’s custody and compliance with court orders. However, the Ondo State Police Command’s response to the accusations was not included in the report.
