Court restrains over alleged imitation of Fearless Energy Drink

A federal high court in Abuja has ordered Mamuda Beverages Nigeria Limited to suspend production of its “Pop Power” energy drink following allegations of trademark infringement brought by Rite Foods Limited over its Fearless Energy Drink brand.

In a ruling delivered on Monday, Justice Binta Nyako held that the packaging and bottle design used for Pop Power bore a “striking resemblance” to the Fearless Energy Drink product manufactured by Rite Foods.

According to a report by TheCable, the court granted an interim injunction restraining Mamuda Beverages from further production of the product pending the determination of the substantive suit.

Justice Nyako also dismissed a preliminary objection filed by Mamuda Beverages in the case marked FHC/ABJ/CS/705/2025.

The company had argued that the suit constituted an abuse of court process, claiming that the complaint was separate from an earlier trademark dispute already settled between both parties.

However, the court ruled that the redesigned packaging introduced by Mamuda still closely resembled the established identity of Fearless Energy Drink.

The judge further directed Mamuda Beverages to immediately halt production of the disputed product and ordered the court bailiff, alongside representatives of both companies, to compile and submit an inventory of products already manufactured.

She, however, permitted the distribution of products that had already been produced before the order.
