Court rejects KC Luxury’s medical bail application, fixes trial for November 2

A Federal High Court in Lagos has rejected the medical bail application of businessman and social media influencer Afolabi Kazeem, popularly known as KC Luxury, over alleged 184.5kg cocaine trafficking and money laundering.
Justice Musa Kakaki, in his ruling on Wednesday, held that the defence had failed to establish special circumstances to justify bail on medical grounds, noting that the application lacked sufficient evidence to warrant the defendant’s release.
“There is no medical certificate to warrant the court to grant him bail,” Kakaki ruled, adding that an expert should explain the nature of any illness relied upon to support a bail application.
However, the judge directed the Ikoyi Custodial Centre to grant Kazeem unrestricted access to doctors and medical specialists for treatment of any health condition. He also ordered an accelerated hearing of the case and fixed November 2, 2026, for the commencement of trial.
At the previous proceedings on Friday, Kazeem was brought to the court premises in an ambulance while receiving oxygen. His counsel, Emefo Etudo, had sought bail to enable him to obtain specialised medical treatment at the Lagos University Teaching Hospital (LUTH), arguing that his health had deteriorated following a reported collapse of his lungs.
Opposing the application, prosecution counsel Abu Ibrahim argued that the medical evidence presented by the defence did not sufficiently justify Kazeem’s release. He also said the defence had failed to provide documentation from LUTH indicating that the hospital could not manage the defendant’s condition.
In his ruling, Kakaki reviewed the medical evidence previously submitted by the defence, including photographs of an individual receiving treatment in a hospital bed. He also recalled an earlier recommendation for Kazeem to be assessed by a consultant respiratory physician or pulmonologist but held that the evidence did not establish an untreated illness or any change in circumstances warranting bail.
Kazeem is standing trial alongside Boniface Freeman Ochoche Sule and Ikechukwu Ekugo Patriarch over the alleged trafficking of 184.5kg of cocaine and money laundering. Following the rejection of his bail application, the court adjourned the case until November 2, 2026, for the commencement of trial.
